Quarry seeks injunction

The owners of JFK Quarry have commenced legal proceedings against the Mohawk Council of Kahnawake (MCK), filing an application with the Superior Court of Quebec for an injunction that would order the MCK not to stand in the way of its quarry restoration plan.

Frank McComber, who co-owns JFK, declined to comment on the proceedings at this time.

The notice of application and related documents are currently with the court and were unable to be viewed by The Eastern Door at the time of writing. The documents are expected to be available for viewing in the coming weeks.

According to a press release by the MCK on Tuesday, the Council was served with notice of the legal proceedings last Friday afternoon. In the application, the plaintiff (JFK) alleges that delays associated with MCK authorization requirements, including the processing of its permit application under the Kahnawake Sanitary Conditions Law, will result in imminent harm, including claims of lost business opportunities and profits and the potential loss of the 2026 operational season.

According to the press release, the plaintiff also argues that the Kahnawake Sanitary Conditions Law exceeds the regulatory authority granted to band councils under the Indian Act in relation to environmental matters, inspector powers, and penalties.

A spokesperson for the MCK said they were also unable to comment on the issue further as the matter is now before the courts.
