Council chief faces DUI charges

Mohawk Council of Kahnawake chief Carl Horn was at the Valleyfield courthouse for a hearing recently, related to a September 2018 drunk driving arrest.

According to court documents obtained by The Eastern Door, Horn has been criminally charged with two counts of drunk driving and one count for violating his probation for a previous DUI arrest in 2007, and appeared in court August 20.

“Carl Horn (001). On or about September 14, 2018, in Saint-Isidore, district of Beauharnois, did operate a motor vehicle, while his ability to drive or operate was impaired by alcohol or a drug, committing thereby the offence punishable on summary conviction provided by section 253(1) a) -255 (01) of the Criminal Code,” the first charge reads.

“Carl Horn (001). On or about September 14, 2018, in Saint Isidore, district of Beauharnois, did operate a motor vehicle having consumed alcohol in such a quantity that the proportion thereof in his blood exceeded 80 milligrams of alcohol in 100 millilitres of blood, committing thereby the offence punishable on summary conviction provided by section 253 (1) b)-255 (1) of the criminal code,” the second charge reads.

The Eastern Door contacted the Mohawk Council of Kahnawake to clarify what these charges could mean for Horn as chief, and MCK press attaché Joe Delaronde sent a statement via email that read:

“We are aware of the situation and are monitoring it closely. We have been advised that we should not offer any further comment at this time, though that may change in the future.”

The Eastern Door also attempted to reach Horn numerous times, but did not get a response.

The third charge is related to a probation violation.

“On or about September 14, 2018, in Saint-Isidore, district of Beauharnois, bound by a probation order in the file 15CC011354, failed or refused to comply with that order by neglecting to respect a condition of the order; to wit: do not drive a motor vehicle if any presence of alcohol in the body committing thereby the offence punishable on summary conviction provided by section 733.1 (1) b) of the criminal code.”

Further, section 733.1 (1) b) of the Criminal Code states that an of-fender who is bound by a probation order and who, without reasonable excuse, fails or refuses to comply with that order, is guilty of an offence punishable on summary conviction, and is liable to imprisonment for a term of not more than 18 months, or to a fine of not more than $5,000, or to both.

This essentially means this is the second time Horn has been arrested for impaired driving, making him a repeat offender.

Horn was arrested for drunk driving on March 3, 2007, in Montreal and was charged with four counts, but only pleaded guilty to one count for impaired driving.

He was sentenced to pay a $2,500 fine in that case.

The Eastern Door spoke to the crown prosecutor, Camille Taillefer, who said, “On August 20, the case was adjourned until October 24, 2019, in order for the defendant to either plead guilty or to set a trial date.”
